Template: the foreign worker placement contract
The placement contract is the second of the three framework templates approved by Order MMFTSS no. 655/26.05.2026 (Official Gazette no. 484 of 11 June 2026) and the only tripartite one: it is signed by the placement agency, the employer and the foreign worker. It brings together in a single document the elements of the firm job offer and the rights and obligations of all three parties, under OUG no. 32/2026 on the access of foreigners to the Romanian labour market.
Special rules for the placement contract
- Mandatory bilingual drafting. The contract is mandatorily drafted in Romanian and, as the case may be, in the language of the foreigner's country of origin or in an international language which they understand or which they may reasonably be presumed to understand. The Romanian version is the legally authentic one (art. 3 of the order).
- An original copy for each party. The placement agency is obliged to hand an original copy of the placement contract to each of the contracting parties, before the start of the activity (art. 4 para. (1) of the order) — and the worker receives a copy before leaving the country of origin.
- Moment of conclusion: before obtaining the long-stay visa for employment, respectively the residence permit for work purposes (art. 4 para. (2) of the order).
- Exclusive use of the framework template, under penalty of absolute nullity of contracts that do not contain the mandatory elements (art. 2 of the order); additional specific clauses remain permitted by negotiation.
Key points of the template
- The 6-month rule: the worker cannot change employer in the first 6 months from the start of the activity registered in REGES-ONLINE, except for justified cases of serious breach by the employer; between 6 months and 2 years the change is possible only through the placement agency that is a party to the contract.
- Protection against abuse: the prohibition on withholding identity documents, on restricting freedom of movement, on forced labour; working conditions cannot be inferior to those agreed.
- Romanian language courses: the employer provides them, with elements of cultural integration, for at least 6 months from the start of the activity, at least 6 hours per week.
- Cost transparency: the fees charged by the authorities are listed explicitly, with a mention of who bears them; the agency cannot charge fees or commissions from the worker.
- Contact details of the institutions (Labour Inspection, IGI, Romanian Police, ANITP, ANOFM) — a mandatory part of the contract, so the worker knows where to report violations.

V. Rights and obligations of the parties
Article 4
The agency has the following rights and obligations:
a) to ensure the worker is fully informed about their rights and obligations;
b) to ensure the placement contract is drafted in Romanian and in a language understood by the worker;
c) to make available to the worker or to send them, by means of remote communication, to the addresses agreed in the contract, a copy of this contract before leaving the country of origin;
d) not to charge fees or commissions from the worker for placement services;
e) to observe the principles of non-discrimination and equal treatment.
Article 5
The employer has the following rights and obligations:
a) to observe all the working, salary and benefit conditions established by this contract;
b) to ensure the worker has access to all the rights provided by the Romanian labour legislation;
c) not to substitute the agreed working conditions with inferior ones;
d) to pay the salary rights in the amount and on the dates established;
e) to ensure occupational safety and health according to the Romanian legislation in force;
f) not to restrict the worker's freedom of movement and not to withhold their identity documents;
g) to notify the worker, in writing, of any change in the working conditions, before it occurs;
h) to notify the placement agency, within 5 working days from the date of the finding, about:
- (i) the foreign worker's unjustified absence for a period of more than 3 consecutive working days;
- (ii) the termination of the individual employment contract;
- (iii) any situation in which the foreign worker is in danger, is subject to exploitation, or in which non-compliance is found with the conditions underlying the granting of the right to work and reside;
i) to keep at the registered office or at the working points a copy of the travel document or residence permit showing the legality of the foreigner's stay on Romanian territory;
j) to ensure the individual employment contract is concluded both in Romanian and in the language of the foreigner's country of origin or in an international language which they understand or which they may reasonably be presumed to understand;
k) to provide, directly or through accredited providers or in collaboration with public institutions, non-governmental organisations, international organisations or educational institutions, Romanian language courses that also include elements of cultural integration, for a period of at least 6 months from the date of starting the activity on Romanian territory, registered in REGES-ONLINE, with a duration of at least 6 hours per week;
l) to guarantee the access of employed foreigners to complaint and abuse-reporting procedures, under conditions of confidentiality.
Article 6
(1) The worker has the following rights and obligations:
a) to observe the conditions and terms of the placement contract;
b) to perform the agreed activity, in compliance with the internal regulations, the occupational safety and health rules, the rules of work discipline, as well as the legal provisions and the employer's instructions, under the conditions provided by Law no. 53/2003 — the Labour Code, republished, as subsequently amended and supplemented;
c) to provide true, complete and up-to-date information regarding their identity, professional qualifications, work experience and state of health;
d) to report to the workplace and carry out their activity according to the conditions established by the individual employment contract;
e) to notify the employer and the agency of any difficulty in performing this contract;
f) not to change employer for a period of 6 months from the date of starting the activity on Romanian territory, registered in REGES-ONLINE;
g) they may change employer before the 6-month period in duly justified cases of serious breach by the employer of the contractual clauses and conditions or of the employment relationship;
h) to observe the applicable Romanian legislation throughout the stay on Romanian territory.
(2) After the expiry of the period provided in para. (1) let. f) and g), the foreigner may change employer only through the placement agency that is a party to the placement contract, until 2 years have elapsed from the date of starting the activity on Romanian territory, registered in REGES-ONLINE.
VI. Protection against abuse
Article 7
(1) The employer has no right to withhold the worker's identity documents (passport, residence permit or other documents), in any form or under any pretext.
(2) The employer has no right to restrict the worker's freedom of movement outside working hours.
(3) Any form of forced labour, physical or psychological coercion of the worker is prohibited.
(4) The worker's working and living conditions cannot be inferior to those agreed by this contract.
(5) In case of reporting possible situations of human trafficking or labour exploitation, the worker has the right and the duty to notify the competent authorities.

VIII. Consent regarding the processing of personal data
Article 9
(1) By signing this contract, the worker declares that they have taken note and been informed about the processing of their personal data by the agency and the employer, for the purpose of performing this contract and fulfilling their legal obligations, including for:
a) activities related to labour placement and the management of employment relationships;
b) communication with the competent Romanian authorities in order to obtain the necessary approvals and permits;
c) the payment of salaries and social contributions;
d) other purposes related to the performance of the individual employment contract.
(2) The worker is informed that their personal data will be processed in compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), and that their rights (of access, rectification, erasure, restriction, objection and portability) may be exercised by written request addressed to the data controllers.

IX. Duration and termination of the contract
Article 10
(1) This contract enters into force on the date of signature by all three parties and produces effects for the duration of the worker's individual employment contract.
(2) This contract terminates by law on the date of termination of the worker's individual employment contract, on the date of expiry of the residence permit for work purposes or on the date of leaving Romanian territory without maintaining the right of residence for work purposes.
(3) If the employer does not observe the working and salary conditions provided in this contract, the worker has the right to address the courts or the authorities provided in art. 8.
X. Final provisions
Article 11
(1) Any change to the conditions established by this contract is brought to the worker's knowledge in writing and requires the agreement of all contracting parties.
